The following terms and conditions governing the use of Marvoto Fetus Camera services (this "Agreement") constitute a valid contract made between you and Marvoto Technology ("Marvoto "). This Agreement stipulates your legal rights and responsibilities concerning the use of Marvoto Fetus Camera, software, services, and associated websites (collectively referred to as this "Service"). "You" refers to any individual who uses and/or accesses this Service.

You must agree to these terms and conditions before using this Service and any corresponding agreements made between you and Marvoto. Please read the following terms carefully. By selecting the check box at the end of this Agreement, you acknowledge that you have read and accepted the provisions contained herein. If you disagree with any part of this Agreement, do not use this Service.

1. Data protection Marvoto respects the privacy of all Marvoto Fetus Camera users. Marvoto shall process and use such data where this is granted or implied by this Agreement in order to provide to you the Service. Marvoto will not disclose, transfer, or provide your personal information (such as your nickname, profile picture, gender, age, phone number, and email address), or your photo and video data to a third party without your prior consent, unless such disclosure is required by law. Marvoto may, however, call upon data processing services of other service providers in order to render the services, provided that such data processing is compliant with applicable data protection laws.

2. Third-party services Network operators and/or third parties may use the Marvoto Fetus Camera platform to provide supplementary products and services, such as third-party apps and services. By using such third-party products and services, you agree to the third party's service terms. Marvoto has no control over the content of third-party products and/or services; therefore you are strongly recommended to read third-party service terms and privacy policies carefully. Marvoto shall not assume any liability for any damages you may incur by using third-party products and/or services.

3. Data collection By opening the Marvoto Fetus Camera app and touching "Agree" in the pop-up dialog box, or by using Marvoto Fetus Camera app, you acknowledge that Marvoto shall collect and analyze your data, including but not limited to your photo and video data. Please refer to section two of this Agreement for information on the use of your data by third parties.

4. Risks and responsibilities (1) Marvoto makes no representations of any kind about the suitability, continuity, security, accuracy, timeliness, and/or legality of this Service and its data. Marvoto shall not be held liable if you are unable to access Marvoto Fetus Camera due to network issues or faults with telecommunications infrastructure, third-party websites, or network operators. Unless otherwise stipulated, this Service is provided to you free of charge. However, some services require the use of your phone's calling, mobile data, and/or SMS messaging features, therefore you may incur charges from third parties for the use of these services. (2) You shall be responsible for all losses or damages incurred due to your confidential information, or information that you deem to be confidential, being disclosed or divulged, or obtained, used, or transferred by a third party as a result of force majeure or negligence on your part. Marvoto shall not assume any liability for such losses or damages. (3) All data and information provided by Marvoto Fetus Camera is for reference purposes only and should not be used for medical purposes or to assess your state of health. Marvoto shall not be held liable for any risks or accidents arising due to using Marvoto Fetus Camera data for such purposes.

5. Terms of use Marvoto and its licensors own all intellectual property rights for the software used to provide the Service (“Software”). You may use this Service provided that you comply with national laws and regulations and this Agreement. You must not undertake any of the following activities, including but not limited to: (1) Deleting any copyright notices or statements and/or any other information or content contained in the Software. (2) Reverse engineering, reverse compiling, or decompilingthe Software, unless where expressly permitted by law. (3) Using, copying, modifying, leasing, or transferring the right to use this Service or the Software in whole or in part, except as expressly provided in this Agreement or technically necessary for the use of this Service. (4) Providing the Software to a third party, licensing a third party to use this Software, or using the Software for purposes forbidden by Marvoto (such as commercial purposes). (5) Using images, text, or other content in this Service for unauthorized purposes, including but not limited to: using, copying, altering, adding links to, reproducing, compiling, or publishing such content, or using such content to create mirror sites or develop derivative products, works, and/or services. (6) Using this Service to store, publish, or disseminate illegal content. (7) Using this Service to store, publish, or disseminate content that infringes intellectual property rights, trade secrets, or other legal rights. (8) Engaging in behavior that jeopardizes the cyber security.

6. Version updates Marvoto reserves the right to decide whether to release updates for the Software. If Marvoto decides to release an update for the Software, this Agreement shall apply to the new version unless a replacement agreement is provided. By updating to the latest version of this Software, you acknowledge that you agree to abide by all of the provisions in the relevant agreement. If you disagree with any of the content in the agreement, do not update to the latest version.
